This document is a translation provided for the convenience of non-French-speaking users. Mandragore Planète is a French company (SAS) with its registered office in France, subject to French law. In the event of any discrepancy or conflict of interpretation between this translation and the French version, the French version alone shall prevail and shall be legally binding.
Article 1 — Purpose and scope
These Terms and Conditions of Sale ("Terms") govern the sale of access to the AI engine and workspaces offered on Bidouchat.ai, published by Mandragore Planète. Any order placed on the site implies full and unreserved acceptance of these Terms, in accordance with Articles L. 221-1 et seq. of the French Consumer Code relating to distance selling.

Article 3 — Products and services offered
Bidouchat.ai offers paid access to an artificial intelligence engine, in the form of a professional workspace or a learning workspace, as well as to an AI conversational assistant (chatbot). Each workspace grants access to a set number of credits, consumed according to usage, which can be topped up at any time via AI top-ups. Access to the Service does not rely on any subscription or fixed-term commitment: it consists of a one-time workspace purchase, freely supplemented by credit top-ups on demand.
Article 4 — Price
Prices are shown in euros, all taxes included. Bidouchat.ai reserves the right to change its prices at any time, it being understood that the price applicable is the one in force at the time the order is confirmed.
Article 5 — Order and payment
Orders are placed directly on the site and payment is processed securely by Stripe, a third-party payment provider. Bidouchat.ai does not collect or store any banking data. The order is deemed final once payment is confirmed by Stripe.
Article 6 — Access to the Service
Access to the purchased workspace (professional or learning) is activated immediately upon payment confirmation, via the customer account created or used when placing the order. Each workspace includes a defined number of credits; beyond that volume, the user may purchase additional AI top-ups at any time, without subscribing to any recurring plan. Purchased credits do not expire and can be viewed in the customer account.
Article 7 — Right of withdrawal
In accordance with Article L. 221-28 13° of the French Consumer Code, the right of withdrawal does not apply to digital content not supplied on a tangible medium, the performance of which has begun after the consumer's prior express agreement and express waiver of the right of withdrawal.
Accordingly, by confirming the order and requesting immediate access to the workspace or AI credits, the customer expressly acknowledges and accepts that performance of the Service begins as soon as payment is confirmed, and waives the standard 14-day withdrawal period otherwise applicable to distance sales.
Article 8 — Legal warranties
In accordance with applicable law, the customer benefits from the legal warranty of conformity (Articles L. 217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code), without prejudice to the intangible and continuous nature of the Service provided.
Article 9 — Liability
Bidouchat.ai uses reasonable means to ensure the availability and quality of the Service. However, Bidouchat.ai cannot be held liable for temporary interruptions related to maintenance, force majeure events, or malfunctions attributable to third parties (hosting provider, AI engine supplier, payment provider).
Article 10 — Intellectual property
The AI engine, the Bidouchat.ai software, its code, its design, the structuring of workspaces (professional and learning) as well as the selection and organization of the content offered are the exclusive property of Mandragore Planète.
Some responses generated by the conversational assistant rely on artificial intelligence models, including an internal model developed by Mandragore Planète and third-party models. In accordance with French law, which reserves copyright protection to works reflecting the personal imprint of a natural person, Mandragore Planète claims rights over the organization, configuration, and structuring of the workspaces and journeys offered, rather than over the raw text generated by third-party AI models taken in isolation. Exchanges between the user and the conversational assistant of the Bidouchat.ai workspace generate interaction logs that may be used by Mandragore Planète to improve the Service, under the conditions set out in our Privacy Policy. The Customer retains ownership of their own data and published content.
Article 11 — Personal data
The processing of customers' personal data is governed by our Privacy Policy, compliant with the General Data Protection Regulation (GDPR).
Article 12 — Consumer mediation
In accordance with Article L. 616-1 of the French Consumer Code, consumer customers have the right to use a consumer mediator free of charge to seek an amicable resolution of any dispute with Bidouchat.ai. The designated mediator is CMAP (Centre de Médiation et d'Arbitrage de Paris): www.cmap.fr.
Article 13 — Governing law and jurisdiction
These Terms are governed by French law. In the event of a dispute, and after any attempt at amicable resolution has failed, the French courts shall have exclusive jurisdiction.
Article 14 — Amendment of these Terms
Bidouchat.ai reserves the right to amend these Terms at any time. The applicable Terms are those in force on the date of the order.
This document is a draft based on French legislation relating to distance selling (French Consumer Code). Before final publication, have it validated by a lawyer, in particular regarding Article 7 (right of withdrawal), which must be accompanied by an explicit waiver checkbox at the time of payment, not merely a clause within the Terms.
